摘要 | Constitutional building is the key for a developing country to its democratic consolidation. A developing country is democratically “secured” if and only if all major political actors commit to the constitutional rules as defined by its constitutional court. Taiwan has reached, in this aspect, the status of democratic consolidation around 2000 and the major political actors did follow the constitutional rules most of the time. There is no denying that the Constitutional Court of Taiwan, the Justices, contribute somehow to this developing process. However, one does not witness the fact that, in case of Taiwan, the Justices took the initiative. Instead, it followed or played along with the popular sovereignty. Only when the general public showed enough inclination toward democratic transition, did the Justices play along with the tide. |
